Impunity for the crime of forced indecency? Starting from the Taiwan High Courts 110-year Appeal No. 1257 Judgment
This article aims to use the current legal vacuum problem of unpunished and attempted forced indecent crimes as a basis for discussion, examine the development trajectory and theoretical evolution of the concept of "indecent", evaluate the subject judgment of the Taiwan High Court, and propose the protection of legal interests along with sexual compulsory crimes. Due to the adjustment of the connotation, it may be difficult for judicial practice to apply the traditional case law in an integrated manner. In order to avoid being out of touch with the actual situation, it is appropriate to develop a new interpretation approach that can be followed, and then reflect on whether the connotation of the current concept of compulsory crime and the protection framework are important. necessary and how to make it possible
