Examining and Reflecting on the Treatment Systems of Observation, Voluntary Abstinence, and Compulsory DetoxificationA Comparison of Legislation in the United States and Germany
The observation and compulsory treatment system are important components of our country's drug treatment system. However, due to the use of imprisonment, lack of good evaluation and diversion mechanisms, flexible treatment plans, professional rehabilitation programs, adequate human resources, and long-term follow-up and counseling mechanisms, the effectiveness is limited, causing serious burdens for all parties involved in the system. This article explores why the observation and compulsory treatment system has become the way it is today. It outlines the development and current situation of the observation and compulsory treatment system and tries to point out the reasons for the current institutional difficulties. The fundamental thinking logic that supports the system has not addressed the nature of drug abuse or addiction as a "disease," still viewing it as a "criminal" wrongdoing that needs to be corrected and eliminated, leading to a continued tense relationship between the treatment system and its subjects. By understanding the deep operational logic of the system, the article points out that to improve the current situation of the system, fundamental changes are needed to address the adversarial relationship that exists within the system. Therefore, the article outlines the drug treatment systems in the United States and Germany, comparing their practices with our country's system. By understanding the deep thinking behind the design of these systems, it provides a basis for contemplating the reform of our country's system.
