The introduction content: Wages are the labor's work reward, and also the main economic source for labor and their families. Pension and severance pay are the ties to the retirement (resignation) life of the labor, so the protection of wages, pensions, and severance pay is very important. In order to ensure that the workers are immediately protected when the employer closes down, clears out, or declares bankruptcy, and are free from the sudden loss of their livelihood, the government specially established the wage arrears compensation fund system in Article 28 of the Labor Standards Law, to promote the spirit of mutual assistance among enterprises and the social responsibility, and to strengthen the protection of labor's economic life. All business units that are subject to the Labor Standards Law shall pay 0.25% of the total salary for the employed labor each month to the wage arrears compensation fund. When the employer closes down, clears out, or declares bankruptcy, the wages owed to the worker, the retirement pay under the Labor Standards Law, the severance pay, or the severance pay under the Labor Retirement Pay Act, can be advanced by the fund for wage arrears, and the employer should repay the compensation to the wage arrears compensation fund within the prescribed period.
